Michael Jordan Tells Court He Felt No Fear of Nascar in Antitrust Trial
Michael Jeffrey Jordan, as he cordially introduced himself in a Charlotte court on Friday, admitted that his drive to win and status as a newcomer emboldened his push for 23XI Racing to âchallengeâ Nascar over perceived violations of antitrust rules.
Financial Stakes and a Will to Win
Jordan shared operational insights of his racing venture, revealing he invested $40m of his personal wealth into the Nascar Cup series team co-founded with business partner Curtis Polk and longtime driver Denny Hamlin.
âIt fell to someone to act,â Jordan stated in the Charlotte courtroom. âAs a newcomer, I had no fear. I felt I could challenge Nascar as a whole. I felt as far as the sport required examination from a different view.â
The Core Dispute: Franchise System and Contract Pressure
At issue is the expiration of a 2016 deal where Nascar granted each team a franchise. The concept is similar to other professional sports with independent franchises, like the Charlotte Hornets or the NFLâs Panthers. The agreement was set to expire in 2024 when Nascar insisted on teams renew their charters.
Jordan testified for an hour and exited the courthouse to pandemonium, with fans and media vying for a view or a photo of the sports legend.
Spearheading the Fight
23XI Racing is at the forefront of the push along with Front Row Motorsports for Nascar to overhaul a business model Jordan contended is breaking the law to keep two hands on the wheel.
At issue for Jordan and a fellow team representative, who testified before Jordan, are details from last September. She recounted a hectic and tense six hours where the sanctioning body told teams they had to sign a contract extension. The document consists of over a hundred pages outlining pay for chartered teams and a guaranteed entry in every race.
A Refusal to Sign
Jordan said that his team and its ally concluded their sole viable path was to refuse a signature that 112-page package and take the issue to court. All other teams agreed to the terms.
The team owners approached Nascar about potential amendments or negotiations. Nascar wasnât talking, according to his testimony.

Heather Gibbsâ Testimony
Heather Gibbs detailed her request for permanent charters, submitted in a formal letter to Nascar. She said the pressure of the signature deadline was problematic.
She said, Joe Gibbs first tried to call and persuade Nascar against forcing signatures, but CEO Jim France refused the appeal.
âPlease donât force this on us,â Gibbs recounted was the message to Nascarâs leadership. The response was, âWhether I have 20 charters, thatâs what I have. If there are 30, I have 30.â
