The former personal attorney for Donald Trump has left her position as the chief federal prosecutor in the state. This comes after a court battle that challenged her legal standing to hold the office.
Acceptance of Resignation
US Attorney General, Pam Bondi, accepted the prosecutor's departure on Monday. She commented that the appeals court finding made it "untenable" for Habba to effectively run her office.
"Do not interpret compliance for surrender," Habba stated. "This battle will now reach across America."
Judicial Challenge
Habba's exit follows closely on a judicial panel found that she had been serving in violation of the law as the top prosecutor. This ruling is expected to impact many criminal cases in the state.
The court declared that a acting appointment that bypassed confirmation by the US Senate breached the Federal Vacancies Reform Act.
Future Role and Reaction
The Attorney General added that Habba will continue working within the DOJ as a senior adviser. Habba plans to challenge the decision of the court's action, aiming for a different outcome.
In a statement, she argued that judges "should not be able to override the President's choice of attorneys tasked with performing the fundamental role of the presidency of criminal prosecution."

Habba, first joined Donald Trump's lawyers in 2021. She went on to represented the former president in his hush-money trial in New York last year, which resulted in his conviction on 34 counts of falsifying business records.
Prior to her appointment to the top New Jersey post, Trump had revealed he was naming her as his senior adviser in a potential future term, calling Habba as "unwavering in her loyalty" and a "tireless advocate for justice".
